Chapter 1 General Provisions
Article 1 (Purpose)
The purpose of these terms of use is to specify the conditions and procedures of use, the rights, obligations and responsibilities of this website and its users, as well as other applicable conditions regarding all services (hereinafter referred to as ‘services’) offered by SU Online Korean Language Institute’s website (www.sukorean.com, hereinafter referred to as ‘SU Online Korean Language Institute’). The website includes the primary and secondary website domains of sukorean.com and its relevant websites.
Article 2 (Posting and Amendments of Terms)
1. SU Online Korean Language Institute posts these terms and conditions on all website pages so users can easily understand them.
2. All content and marks provided by SU Online Korean Language Institute are copyrighted, as indicated at the bottom of the homepage.
3. SU Online Korean Language Institute is entitled to amend any of the terms of use unless such amendments violate applicable regulations, such as the Regulations of Standardized Contracts Act, Framework Act on Electronic Commerce, Electronic Signature Framework Act, Act on the Promotion of Information and Communication Network Utilization and Information Protection, Door-to-Door Sales Act, Consumer Protection Act of E-commerce Law, etc.
4. The effective date and reasons for amendment shall be posted at the top of the website along with the current terms of use from seven days to a day before enforcement.
5. SU Online Korean Language Institute shall provide services to users, only if such users agree to the terms of use. Under this agreement, the terms of use shall apply to the services of this website and the use of such services on a preferential basis.
6. In agreement with these terms of use, users shall visit the website periodically to check and agree to amendments. SU Online Korean Language Institute shall not be liable for damages to users due to their unawareness of the amendments.
7. If members do not agree to the amendments, they may request to terminate (cancel) their account. If a user continues to use the website services seven days following the enforcement without refusing to accept the amendments, they are deemed to have agreed to such amendments.
8. The issues not specified in these terms of use are subject to the Framework Act on Telecommunications, Telecommunications Business Act, Audit Regulations of Korea Communications Standards Commission, Ethics Code on Information Communications, Computer Programs Protection Act, and other applicable regulations.
Article 3 (Definitions)
These terms of use are subject to the following definitions.
1. User refers to a person who receives SU Online Korean Language Institute services pursuant to these terms of use.
2. ‘Use agreement’ refers to the use of service contract between SU Online Korean Language Institute and users.
3. Enrollment refers to entering the required information in the SU Online Korean Language Institute application form and agreeing to these terms of use to complete the service use agreement.
4. Member refers to a person who has registered as a member of SU Online Korean Language Institute, who uses the information and services of SU Online Korean Language Institute, or who receives services from SU Online Korean Language Institute through a contract between the member's affiliated organization (e.g., public institution, general corporation, elementary/middle/high school/university, etc.) and SU Online Korean Language Institute.
5. ‘Email address (ID)’ refers to an electronic mail address granted by SU Online Korean Language Institute for user identification and service procedures or an electronic mail address used respectively by a user.
6. ‘Password (PW)’ refers to the combination of letters and numbers created by user to identify their membership and protect private information online.
7. ‘Termination (Cancellation)’ refers to canceling a member's use agreement.
8. The terminology not defined in these terms of use shall be defined in respective terms of use on services and regulations.
Chapter 2 Establishment and Termination of Use Agreement
Article 4 (Establishment of Use Agreement)
1. A use agreement is established when a user agrees to the terms of use and SU Online Korean Language Institute approves the request made by the user.
2. A use agreement is established when a user agrees to these terms of use by clicking the ‘agree’ button on this website.
3. Agreement to these terms of use shall take effect when a user agrees to these terms of use for enrollment or seven days after the amended terms of use are publicized on the notification of amendment.
Article 5 (Sign up and Cancellation)
1. An applicant shall be deemed to have completed the enrollment procedure after entering all necessary data in the online application form offered by SU Online Korean Language Institute.
2. SU Online Korean Language Institute is entitled to cancel a membership due to any of the following reasons.
1) It was created under false name.
2) False information was entered in the membership application form.
3) It was created to disturb social security or harm traditional customs.
4) A member disturbs other members or has stolen their information.
5) A member has violated the regulations or these terms of use.
6) An applicant was not fully eligible for a membership as specified by SU Online Korean Language Institute.
3. SU Online Korean Language Institute is entitled to suspend the effects of use agreements due to any of the following causes until such a cause is resolved.
1) The infrastructure is insufficient for services.
2) Technical issues have occurred.
3) Natural disasters or national contingencies have occurred.
4) Other reasonable problems have occurred.
4. If the following cases occur, SU Online Korean Language Institute is entitled to modify its services after notifying users of such changes.
1) Services developed by SU Online Korean Language Institute or through partnerships with other companies or institutions have changed.
2) The posts and files uploaded by a user have violated the purpose of the service.
5. If a member must change their profile, they must promptly notify SU Online Korean Language Institute’s administrators of such changes by editing the profile data or using other methods.
6. Users may terminate (cancel) their membership at any time if they do not want to continue using SU Online Korean Language Institute’s service.
Article 6 (Granting and Modification of User ID)
1. SU Online Korean Language Institute shall grant user IDs per these terms of use. A user’s existing email address or a new one offered by this website shall be registered as a user ID.
2. A user ID cannot be modified. Users must cancel their IDs and create new ones if they modify them due to unavoidable causes.
3. A user ID is eligible for modification at the user’s or company’s request in any of the following cases.
1) A user ID contains a user’s phone number or resident registration number, which may cause privacy infringements.
2) A user ID disgusts others or harms traditional customs.
3) There is another reasonable cause.
4. Users are liable for managing their own user IDs and passwords. They are also liable for damage caused by the negligent care of IDs and passwords and the illegitimate use of third parties. SU Online Korean Language Institute shall not be liable for such damages.
5. The terms and conditions regarding the control and modification of the private information of other users shall be specified by SU Online Korean Language Institute.
Article 7 (Agreement to the Use of Member Information)
1. The privacy protection policies of SU Online Korean Language Institute apply to users’ personal information.
2. A member's personal information shall be collected, used, managed, and protected as follows.
1) Collection of personal information: Users’ personal enrollment information shall be collected by this SU Online Korean Language Institute.
2) Use of personal information: Personal information is strictly restricted from use and disclosure unlike regular administrative information. Article 18 (Restriction on Use and Disclosure) of the Act on the Protection and Maintenance of Personal Information states that personal information shall not be used other than for its intended purpose and shall not be provided to third parties except:
- In the case of a user’s specific agreement
- when there is a special regulation in an Act
- when the website cannot obtain prior agreement, such as a user or a legal representative could not express their intentions or their address is unknown; in this case, it is clearly admissible to use the personal information of users or third party, body, or interest of property in urgent situations - When personal information is requested or when an individual’s data are not visible and are needed for making statistical charts or engaging in academic research.
3) Personal information management: Users are entitled to edit or delete their personal information at their own discretion using the profile data management services. They may also change/modify unnecessary incoming data items.
4) Personal information protection: Users can only review/revise/delete personal information under the tight control of user ID and password. Users must not disclose their IDs or passwords to third parties. After completing their work, they must also log out of the website and close the browser. These procedures are required to protect user information when using PCs in public places such as Internet cafes or libraries)
3. If a user agrees to these terms of use for SU Online Korean Language Institute, they will be deemed to have agreed to the collection and use of personal information from their application form according to these terms of use.
Article 8 (Protection of User Information)
1. Users shall be responsible for maintaining the confidentiality of personal information when they finish applying for membership. They shall be exclusively liable for the outcomes of using IDs and passwords.
2. Users shall be responsible for managing their IDs and passwords. They must report any illegitimate use of ID and password to SU Online Korean Language Institute. They shall be liable for all damages caused by the failure to report.
3. Users must log out of SU Online Korean Language Institute after using the website services. SU Online Korean Language Institute shall not be liable for damage and loss caused by the theft and illegal use of user information by third parties.
Chapter 3 Use of Service
Article 9 (Service Hours)
1. Services are available 24-hours a day year-round unless operating or technical problems occur.
2. Despite the terms of services specified in Clause 1, operations may be suspended for regular checkups scheduled by SU Online Korean Language Institute.
Article 10 (Suspension of Service and Notice)
1. SU Online Korean Language Institute shall not be liable for the loss, delivery failure or partial destruction of stored or sent messages or other communication data due to national emergencies, power failure, facility malfunctioning, or other unavoidable causes not under the control of SU Online Korean Language Institute.
2. SU Online Korean Language Institute is entitled to suspend its services by posting a notice of suspension (including causes and schedule) a week in advance if such a suspension is required due to difficulties in service operations. SU Online Korean Language Institute shall not be liable for damages caused by a user's unawareness of the notice. The notice may be posted later than specified above or skipped in unavoidable situations. SU Online Korean Language Institute shall also not be liable for deletion or loss of stored or sent messages and other messages, delivery failure, or destruction of communication data.
3. The permanent termination of service is subject to the terms and conditions stated in Clause 2. In such an event, prior notice must be posted at least a month before termination.
4. SU Online Korean Language Institute is entitled to correct, modify, or suspend services temporarily after prior notice. The institute shall not be liable for damages to users and third parties caused by such changes. 5. SU Online Korean Language Institute is entitled to suspend services temporarily without prior notice for unavoidable causes such as emergency system checkups, facility expansions and replacements. The institute may also terminate any current services to reconstruct them into new services or for other reasonable causes.
6. SU Online Korean Language Institute is entitled to suspend all or part of its services if it is impossible to provide services as usual due to national emergencies, power failures, service facility troubles, or high traffics. In such an event, SU Online Korean Language Institute shall notify users of the causes and suspension period in advance or retroactively.
7. Prior notice is not feasible when services are suspended for causes uncontrollable by SU Online Korean Language Institute (intentional or unintentional technical faults of system administrators, system crashes, etc.).
Prior notice is also not required when the system crashes due to intentional or unintentional faults of third parties (network service providers, communication service providers, etc.).
8. SU Online Korean Language Institute may classify its services into categories and determine their respective operating hours. In this case, such restrictions must be disclosed in advance.
9. SU Online Korean Language Institute is entitled to restrict or cancel service memberships or terminate the use agreement without user consent at its discretion if the user has violated any of the terms of use. In such an event, the website may prohibit access by the violating party.
Article 11 (Disclosure of Information and Posting of Promotional Articles)
1. SU Online Korean Language Institute is entitled to provide a range of information on services to users through online posts, emails, and letters. This information shall be offered electronically only to users who have agreed to receive emails from SU Online Korean Language Institute.
2. SU Online Korean Language Institute is entitled to post promotional articles deemed appropriate for its services or public interests online.
3. SU Online Korean Language Institute may notify users of educational policies and other information through announcements, emails, SMS, and Alert Talk. The institute is not responsible for any damage caused by not receiving information due to spam blocking or incorrect contact information.
Article 12 (Management of Website Postings)
1. The rights regarding users’ posts belong to the user.
2. SU Online Korean Language Institute is entitled to edit and remove any posts without prior notice. The institute is also entitled to delete posts without prior notice in the following cases.
1) The post violates any terms of use or is deemed commercial, illegal, obscene, or vulgar.
2) The post slanders or defames another member or a third party.
3) The post threatens public security or harms traditional custom.
4) The post is linked to criminal activities
5) The post violates rights such as the copyrights of a third party.
6) The post violates other applicable regulations.
3. Users shall be liable for civil and criminal damages if their posts infringe on copyrights.
Article 13 (Advertising and Transactions with Advertisers)
1. Some of SU Online Korean Language Institute’s revenue comes from advertising, allowing the institute to invest in user services.
2. In relation to the operations of SU Online Korean Language Institute's services, advertisements may be posted on the homepage, service screens, applications, emails, SMS, notification messages, etc. Members agree to the posting of advertisements when using the service.
3. Any communication or transaction, such as engaging with advertisements or participating in an advertiser's promotional activities through the service is between the member and the advertiser. SU Online Korean Language Institute is not responsible for any loss or damage arising therefrom.
Article 14 (Service Restrictions)
1. If the user information is proven or suspected as false under rational circumstances, we reserve the right to suspend the user's right to service to and terminate the account. We will not take responsibility for any disadvantages inflicted on the user due to this clause.
2. If the user violates Article 15 (Member Obligations), we reserve the right to restrict or suspend the user's right to service. In this case we reserve the right to sanction or suspend the user's access to the site entirely.
Article 15 (Changes to and Termination of Contract)
1. If a member wishes to cancel their membership, they must personally cancel it.
2. Course cancellations and refunds are accepted through 1:1 Contact on the sukorean.com website.
3. If a member cancels their registration up to 24 hours before the start of the course (based on Korean time), they will be refunded. If a member cancels within six days after beginning the course, they will receive a refund depending on the course status. If a member cancels seven days after the start of the course, they will not be refunded.
4. If a member has attended three or more lessons, a refund is not possible even if within six days of the course start.
5. The refund amount based on the refund criteria, is as follows:
1) Course fees will be fully refunded if a member applies for a refund up to 24 hours before the course starts (Korean time)
2) If a member is less than seven days into the course or has attended less than two lessons, they will receive an 80% refund
3) If a member is more than seven days into the course or has attended three or more lessons, they will be no refunds
6. All costs, including fees incurred by financial institutions (banks, card companies, etc.) during the transaction, will be deducted from the refund.
1) Example 1. A member requests to cancel (refund) a course two days before it begins
[Payment amount - Financial institution fee] transfer to the application account or cancel the card
2) Example 2. A member requests to cancel (refund) a course five days after it begins.
[(Payment amount X 80%) - Financial institution fee] Transfer to the application account or cancel the card
7. When a refund is made, it will be processed using the initial payment method.
Chapter 4 Obligations and Responsibilities
Article 16 (SU Online Korean Language Institute Obligations)
1. SU Online Korean Language Institute shall not engage in activities prohibited by applicable laws, these terms of use, or traditional customs. The institute is obliged to provide consistent and stable services to users.
2. SU Online Korean Language Institute shall neither disclose nor provide members’ personal information to third parties without the consent of relevant members. However, such disclosure is allowed when required by government authorities pursuant to applicable regulations such as the Telecommunications Business Act.
3. SU Online Korean Language Institute must maintain a security system to protect users’ personal information (including credit data) for the safe use of the services.
4. SU Online Korean Language Institute shall not be liable for service issues caused by users.
Article 17(Member Obligations)
1. Members must provide correct information during enrollment make reasonable efforts to maintain and update their personal information and protect their IDs and passwords from illegal use by third parties.
2. Members must not be involved in any profit-making activities based on the services of SU Online Korean Language Institute without prior consent.
3. Members must not copy, reproduce, modify, translate, publish, o broadcast services offered by SU Online Korean Language Institute or provide them to others without prior consent.
4. Members must not be involved in the following activities when using SU Online Korean Language Institute services.
1) Theft or the illegal use of other members’ passwords and IDs
2) Forwarding, posting, disclosing, emailing, or delivering vulgar, obscene, insulting, or threatening information or infringing on the privacy of others
3) Disguising of the original source of service content
4) Posting, disclosing, emailing, or delivering prohibited content
5) Posting, disclosing, emailing, or delivering content that infringes on patents, trademarks, goodwill, copyrights, or other intellectual property
6) Posting, disclosing, emailing, or delivering advertising, promotional articles, spam, chain letters, multilevel marketing advertisements, or other marketing material without approval by SU Online Korean Language Institute
7) Collecting and storing the personal information of other users
8) Activities for criminal purposes or involvement in criminal activities
9) Activities harming public decency and social security
10) Activities defaming or insulting others
11) Activities infringing on others’ intellectual property rights or other rights
12) Computer hacking or distributing computer viruses
13) Consistently forwarding advertising information to others against their will
14) Activities that threaten or are likely to threaten the stable operation of services
15) Modifying information posted on SU Online Korean Language Institute
16) Activities violating other Articles
Chapter 5 Others
Article 18 (Website Ownership)
1. SU Online Korean Language Institute the intellectual property rights and other rights regarding the services offered and the corresponding software, images, symbols, logos, designs, service names, data, and trademarks.
2. Unless otherwise explicitly specified, users are not entitled to revise, borrow, lease, sell, distribute, produce, transfer, sublease, mortgage, or commercialize all or part of properties. They shall not allow third parties to be involved in the activities specified above. However, SU Online Korean Language Institute or the service provider may allow users to utilize such property rights through respective agreements.
3. Users’ posts on SU Online Korean Language Institute shall be owned by the users and SU Online Korean Language Institute.
Article 19 (Prohibition of Transfer)
Members shall neither transfer nor donate their rights to services to others under the use agreement. They must not furnish securities for such rights to third parties.
Article 20 (Indemnification)
SU Online Korean Language Institute shall not be liable for damages to members regarding gratuitous services offered by SU Online Korean Language Institute unless intentional or unintentional criminal activities cause such damages.
Article 21 (Exemption)
1. SU Online Korean Language Institute shall not be liable for the suspension of service caused by natural disasters, wars, or other force majeure.
2. SU Online Korean Language Institute shall not be-liable for damages caused by service providers’ suspended or abnormal telecommunication services.
3. SU Online Korean Language Institute shall not be liable for damages caused by unavoidable situations such as repairs, replacement, regular checkups, or maintenance due to service facilities.
4. SU Online Korean Language Institute shall not be liable for damages caused by the malfunctioning of users’ computers or the incorrect entry of personal information and email addresses.
5. SU Online Korean Language Institute is not obliged to confirm or represent any opinions or information about services. The institute shall not be involved in the approval of, objection to, or correction of the opinions of members or third parties. SU Online Korean Language Institute shall not be liable for interests or damages caused by users’ reliance on the service information.
6. SU Online Korean Language Institute shall not be liable for the damage caused by non-financial or financial transactions for services between members or between a member and a third party. The institute shall not be responsible for members’ profit expectations based on service use.
7. SU Online Korean Language Institute shall not be liable for members’ profit expectations based on service use or damage caused by service information. The institute shall not be responsible for the content and reliability of information, data, and facts offered through membership services.
8. SU Online Korean Language Institute shall not be liable for damage caused by users’ intentional or unintentional mistakes in the use of services.
9. SU Online Korean Language Institute shall not guarantee the accuracy, completeness, or quality of services offered by similar organizations. SU Online Korean Language Institute shall not be liable for damage and loss caused by using the services specified above of for mental harm caused by other members while using the service.
Article 22 (Governing Court)
The Seoul District Court shall handle any legal disputes and lawsuits raised over the use of services.
Supplementary Provisions
1. (Enforcement Date) These terms of use will take effect on December 1, 2024.
